The Allahabad High Court has stayed the order directing registration of an FIR against 22 police personnel, including Sambhal’s Circle Officer Anuj Chaudhary, in the Sambhal violence case. The order was passed by a bench headed by Justice Sameet Gopal. The court granted interim relief for 14 days on the petition filed by former CO Anuj Chaudhary and former station house officer Anuj Tomar, and also gave the complainant, Yameen, 14 days to file his response.
The Allahabad High Court has stayed the order of the Chief Judicial Magistrate (CJM), Sambhal, which had directed the registration of an FIR against 22 police personnel, including former Circle Officer (CO) Anuj Chaudhary, in connection with the Sambhal violence of November 2024. The order was passed by a single-judge bench of Justice Sameet Gopal.
Court Grants 14-Day Interim Relief to Former Sambhal Officials
On the petition filed by former Sambhal Circle Officer Anuj Chaudhary and former Sambhal station house officer Anuj Tomar, the court granted interim relief for 14 days. The court also gave the complainant, Yameen, 14 days to file his response to the petition.
State Claims Non-Police Bullet, Alleges CJM Ignored BNSS Provisions
Earlier, the state government had said that the bullet which injured Yameen’s son, Alam, is not one that is used by the police. The government also argued that the CJM ignored Section 175 of the BNSS. Under this provision, two mandatory steps must be followed before ordering an inquiry against a public servant. The first step is to obtain a report from a senior male officer, while the second is to consider the public servant’s version or statements regarding the circumstances of the incident. The CJM, the government said, completely ignored the police report.
