Toll Pending Vehicle Transfer Rule: If you are planning to sell your vehicle or renew its fitness certificate, negligence could now prove costly. The central government has made it clear that no key vehicle-related process will be allowed unless pending toll dues are cleared. Vehicle transfer, fitness renewal, and permit issuance will all be blocked in case of unpaid tolls. The Ministry of Road Transport and Highways has amended the Central Motor Vehicle Rules, 2026 to implement this change.
Government has Changed the Rules to Tighten the Recovery of Toll Dues
The government is rapidly working towards implementing a barrier-free toll system across the country, known as the Multi-Lane Free Flow (MLFF) system. Under this system, vehicles will not need to stop at toll plazas. Toll charges will be automatically deducted using FASTag, ANPR number plate recognition cameras, and AI technology. However, in many cases, payments fail even after tolls are recorded, leading to revenue losses for the government. The new rules have been introduced to address and prevent this issue.
Why is it Important to Clear Pending Toll Dues?
Under the new rules, if your vehicle has pending dues at any toll plaza, you will not receive a No Objection Certificate (NOC). Without an NOC, the vehicle cannot be transferred to another person’s name. In addition, there will be difficulties in registering the vehicle in another state or district, renewing the fitness certificate, and obtaining or renewing permits for commercial vehicles.
New Definition of Unpaid User Fee
The revised rules have introduced a new definition called Unpaid User Fee. This means that if a vehicle’s passage on a national highway is recorded in the electronic toll collection system, but the required toll amount has not been paid, it will be directly considered as pending. In such cases, no leniency will be allowed.
Changes Have Also Been Made in Form 28
The government has also amended Form 28, which is required for vehicle transfer. Now, the vehicle owner must clearly state whether there are any pending toll dues on the vehicle. If there are dues, full details must be provided. The good news is that the government is promoting digital processes, and the required parts of Form 28 can now also be issued through an online portal.
Risk of FASTag Suspension
If toll dues are not paid despite being pending, the vehicle owner will first be sent an e-notice. If the payment is still not made, the FASTag may be suspended. In addition, other fines and legal actions related to the vehicle may also be imposed.
What will Change in 2026 Under the New Vehicle Toll Rules in India
Union Road Transport Minister Nitin Gadkari has already stated that in 2026, a barrier-free tolling system will be a major government priority. Once implemented, the cost of toll collection is expected to drop from around 15% to just 3%, reducing traffic congestion and making travel faster and more convenient for commuters.
