The Supreme Court has begun hearing the case related to the death of model and actor Twisha Sharma. Twisha was found hanging at her in laws’ house on May 12. She had been married to lawyer Samarth Singh for only five months.
This sensitive case has been listed in the Supreme Court under the title: “Alleged institutional bias and procedural irregularities in the unnatural death of a young woman at her matrimonial home.”
The Supreme Court Expressed Grief
A three member bench comprising Chief Justice of India (CJI) Surya Kant, Justice Joymalya Bagchi, and Justice Vipul M. Pancholi is hearing the case. During the hearing, the bench expressed deep concern over the manner in which the initial investigation was conducted.
Chief Justice of India Surya Kant said, “We have complete faith in our system, but we want this case to be investigated by an independent agency. An unfortunate incident has occurred, and it requires a completely fair and unbiased investigation without any discrimination.”
Praise for the Madhya Pradesh High Court
The Supreme Court praised the Madhya Pradesh High Court for ordering an immediate second post-mortem of model and actor Twisha Sharma. At the same time, the Supreme Court strongly urged the media to exercise restraint while reporting developments in the case.
The court said, “We request the media not to record statements of the victim’s family and not reduce their deep grief to mere television ‘sound bites’.”
Restriction on Statements by Witnesses and Accused
Considering the sensitivity of the case, the Supreme Court has completely barred potential witnesses and the accused from making any statements to the media. The accused’s lawyer also assured the court that a former judge associated with the accused’s family will not give any media statements regarding the investigation.
On this, the court remarked, “We are saddened by certain actions during the investigation; therefore, let the matter proceed strictly in accordance with the law and established procedure.”
Assurance From the Solicitor General Regarding a CBI Investigation
The Supreme Court has recommended handing over the investigation of the case to the Central Bureau of Investigation (Central Bureau of Investigation). The Solicitor General, appearing on behalf of the Madhya Pradesh government, argued in court that significant progress in the investigation has been made due to media intervention.
During the hearing, the Solicitor General made an emotional remark, saying, “It is far better for a daughter to go through a divorce than to face such an unfortunate incident.”
The court has taken on record the assurance given by the Solicitor General that the state government will soon take an official decision regarding a CBI investigation by the Central Bureau of Investigation.
The Supreme Court has, for the time being, disposed of the suo motu case and stated that the concerned parties are free to approach the appropriate forum for further legal remedies.
